Darren Filkins Photographer - Terms & Conditions

Cancellation Policy
If the client postpones or cancels the commission between 72 and 24 hours before the agreed start time, the client will be charged 50% of the agreed fees. Cancellations or postponements within 24 hours of the start time may be charged at 100% of the agreed fees.

Invoicing & Payment
Fees and costs will be negotiated and agreed before the commission takes place. Should the details of the commission change then alterations to the costs will be agreed as soon as possible. New clients may be asked for a purchase order or a letter confirming the commission, agreed fees and costs as well as acceptance of my terms and conditions in advance. Once the commission has been completed an invoice will be sent to you with payment terms and methods outlined. Payment must be made within 21 days from you receiving final artwork unless otherwise agreed. The grant of license will only come into force once payment has been made in full within this period of time. Clients who cannot supply a purchase order will be asked to pay 20% of the final shoot cost in advance in order to secure the date of the proposed shoot. The remainder to be paid in full at the end of the shoot day.

Delivery Methods & Deadlines
As part of the commission we will agree how, when and where the photographs or video will be delivered. Options include WeTransfer link (up to 2gb), web galleries, FTP, email or DVDs and USB flash drives via mail or courier. Large video projects can incur the additional cost of a dedicated hard drive to supply you with your material. Photographs, unless stated, will be supplied in high resolution 300dpi jpeg format for print and lower resolution 72dpi jpeg format for internet. These will be supplied within the agreed deadline. Copies of all files will be retained in line with industry best practice and any subsequent re-issue of any of the image files will be subject to a handling charge.

After The Shoot
Once your photographs have been delivered your pictures will be archived. In the unfortunate event that you lose your computer or have a hardware failure I will be able to resupply your images. There is however an administration fee for this service of £50. Processing of additional images beyond your agreed selection will be charged at £25 per image.

Licenses Granted By Darren Filkins Photographer For Promotional (PR) and Editorial Shoots
As a client for PR or editorial shoots, you will be granted a non transferrable indefinite license for worldwide usage of your images in all media. Use of the final photographs for any other purposes such as advertising would be considered outside of the agreed license and would require further negotiation of fees.

Licenses Granted By Darren Filkins Photographer For Advertising
As a client for advertising, I would negotiate a license tailored to your requirements governed by geographical distribution and duration of time.  

License Extension Options
If having agreed a set of license conditions, you subsequently realise that you need wider use of the photographs or video, I am always happy to negotiate a license extension. 

Copyright
I do not assign copyright to any clients or third parties. Licences are issued on an individual basis.
Please be aware that buying the copyright is far more expensive than buying an extensive and wide-ranging license.

The Limit Of My Liability
As a professional photographer I take great care and pride in my work and in my relationship with clients and the subjects of our photography. I cannot, however, accept liability for unexpected events including poor weather, industrial disputes, sickness or injury, equipment malfunction, model release disputes, property release disputes and other actions or accidents that are outside of my control and that cannot be reasonably predicted. Please note that I carry £1 million of Public Liability insurance and that my photographic equipment is regularly tested.
I store back-up copies of your photographs and videos using reliable systems but cannot accept liability for hardware failure. With this in mind I recommend you keep a back-up copy of all images supplied by me on your own storage system.
